DISPUTES

Any dispute relating in any way to your visit to HAMORE - THE GIFT SHOP or to products you purchase through HAMORE - THE GIFT SHOP shall be submitted to confidential arbitration in ITALY, REPUBBLICA ITALIANA, except that, to the extent you have in any manner violated or threatened to violate HAMORE - THE GIFT SHOPs intellectual property rights, HAMORE - THE GIFT SHOP may seek injunctive or other appropriate relief in any state or federal court in the state of ITALY, REPUBBLICA ITALIANA, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.

3. Angebot und Vertragsschluss

3.1 Die Darstellung der Produkte im Online-Shop stellt kein rechtlich bindendes Angebot, sondern eine Aufforderung zur Abgabe einer Bestellung dar.

3.2 Durch Anklicken des Buttons „I agree with Terms and conditions“ geben Sie eine verbindliche Willenserklärung zur Bestellung der auf der Bestellseite aufgelisteten Waren ab. Der Kaufvertrag kommt zustande, indem wir Ihre Bestellung unmittelbar nach deren Abschluss durch eine Bestätigungsmail an die von Ihnen angegebene E-Mail-Adresse bestätigen. Diese Bestätigungsmail enthält alle Daten der Bestellung inklusive der vorliegenden allgemeinen Geschäftsbedingungen.

3.3. Die Warenbestellung mit Vertragsbedingungen wird bis zu deren Abwicklung von uns gespeichert. Ihnen liegen diese Daten in Form der gemäßen Ziffer 3.2. gesandten E-Mail nach Vertragsschluss vor. Darüber hinaus haben Sie die Möglichkeit, den Vertragstext bei der Bestellung zu speichern bzw. ausdrucken.

3.4. Der Vertragsschluss erfolgt in deutscher Sprache.

4. Rücksendekosten

Üben Sie Ihr gesetzliches Widerrufsrecht (Ziffer 5.) aus, haben Sie die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 999.99€ Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben.

5. Widerrufsrecht

Verbraucher (§ 13 BGB) haben ein gesetzliches Widerrufsrecht. Dies gilt 7 Tage ab Erhalt der Lieferung. Des Weiteren nur und ausschließlich bei beschädigter Ware. Es ist keine Umtauschaktion möglich, sofern die Ware nicht beschädigt ist.

6. Liefergebiet und Kundenkreis

Bestellungen und Lieferungen sind nur innerhalb Europäischen Union möglich. Bei Bestellwunsch oder Lieferwunsch außerhalb dieser Gebiete helfen wir Ihnen gern weiter.

7. Preise und Versandkosten

7.1 Die auf den Produktseiten genannten Preise enthalten die gesetzliche Umsatzsteuer und sonstigen Preisbestandteile.

7.2 Zusätzlich zu den angegebenen Preisen berechnen wir für die Lieferung Versandkosten. Die Versandkosten unter einem Warenkorbwert von 59.99€ betragen 6.95€ Euro (Standardversand). Die Versandkosten werden Ihnen auf den Produktseiten, im Warenkorbsystem und auf der Bestellseite nochmals deutlich mitgeteilt.

8. Zahlung und Auslieferung

Der Kaufpreis ist im Voraus zu zahlen und ist mit Ihrer Bestellung fällig. Die Ware wird erst versandt, wenn der Kaufpreis auf unserem Konto eingezahlt worden ist oder uns eine entsprechende Zahlungsgarantie Ihrer Bank vorliegt. Die Zahlung kann auf folgenden Wegen erfolgen Pay Pal und alle angebotenen Stripe Bezahlmethoden.

9. Eigentumsvorbehalt

Widerrufsbelehrung

Widerrufsrecht Sie können Ihre Vertragserklärung innerhalb von zwei Wochen ohne Angabe von Gründen in Textform (z.B. Brief, Fax, E-Mail) oder – wenn Ihnen die Sache vor Fristablauf überlassen wird – durch Rücksendung der Sache widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Empfänger (bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor Eingang der ersten Teillieferung) und auch nicht vor Erfüllung unserer Informationspflichten gemäß § 312c Abs. 2 BGB in Verbindung mit § 1 Abs. 1, 2 und 4 BGB-InfoV sowie unserer Pflichten gemäß § 312e Abs. 1 Satz 1 BGB in Verbindung mit § 3 BGB-InfoV. Widerrufsfolgen

Im Fall eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z.B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung – wie sie Ihnen etwa im Ladengeschäft möglich gewesen wäre – zurückzuführen ist. Im Übrigen können Sie die Pflicht zum Wertersatz für eine durch die bestimmungsgemäße Ingebrauchnahme der Sache entstandene Verschlechterung vermeiden, indem Sie die Sache nicht wie ihr Eigentum in Gebrauch nehmen und alles unterlassen, was deren Wert beeinträchtigt. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Sie haben die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt.
